TERMS AND CONDITIONS

By purchasing a ticket and attending an event hosted by Montclair Dog LLC (“Montclair Dog”) and located on the property maintained, operated, and controlled by the entity partnering with Montclair Dog for such event (“Host”), I agree to the following terms and conditions a/k/a Pup-ticipation Agreement (the “Agreement”):

- I/we acknowledge and accept that the words “I”, “me”, “my”, and “myself” as used below shall mean all individuals who attend the event through the purchase of one or more tickets to the event, such as, but not limited to, spouses, partners, children, friends, family, etc. in my party/group.

- I represent that I am 18+ years old and the party solely responsible for my dog during the event.

- To the extent I bring any individuals under the age of 18+ years old to this event, I assume all responsibility for such individuals as consistent with the provisions of this Agreement.

- I acknowledge and accept that I am voluntarily participating in a public dog-friendly event hosted by Montclair Dog in collaboration with Host. In doing so I am assuming any and all risks that may or may not be foreseeable at this event, including but not limited to any and all bodily injuries or ailments to me and/or to my dog(s) caused by any dog(s), individual(s), or the premises at this event. Furthermore, I acknowledge and agree that neither Montclair Dog nor Host require proof of spay/neuter/vaccination status of any dog(s) for entry into this event, and I therefore assume any and all associated risks to myself and my dog(s).

- I represent that my dog is friendly, vaccinated, spayed/neutered, will remain under my supervision, and is my responsibility at all times during this event. I represent that my dog(s) will not interfere with the normal course of business of Montclair Dog or with Host, and will abide by all rules and regulations established by the Host, during the event, as determined by Montclair Dog and/or Host. I acknowledge and accept that Montclair Dog and/or Host reserve the right to refuse service to me and my dog(s) and/or to demand that I and my dog(s) leave the event, and to remove me and my dog(s) from the event, for any misrepresentation of any provision of this Agreement without refund.

- I agree to clean up after my dog(s). I acknowledge and represent that I will prevent my dog from urinating and/or defecating on the premises hosting the event.

- I agree to not bring my dog into the areas where dogs are not permitted at any time and for any reason during the event.

- I release and hold harmless Montclair Dog and Host from any claims related to injury, damage, or loss.

- Any dispute, controversy or claim arising out of or relating to this Agreement, or the breach, termination or invalidity thereof, shall be settled by binding arbitration in accordance with the American Arbitration Association, Commercial Arbitration Rules then in effect. The Arbitration shall be held in the State of New Jersey and in the city chosen exclusively by Montclair Dog. My signing this Agreement, I understand that I am waiving my right to a trial by jury in any court of competent jurisdiction. The parties to any such arbitration shall be solely responsible for their own attorneys’ fees and costs.

- If any provision of this Agreement, or part thereof, is held to be invalid or unenforceable in any jurisdiction, such provision, or part thereof, shall be ineffective only to the extent of such invalidity or unenforceability in such jurisdiction, without invalidating or rendering unenforceable the remaining provisions, or rest of such provision, hereof or affecting the validity or enforceability of such provision(s) in any other jurisdiction.
